§ II. Definitions.

As used in this ordinance, unless the context otherwise requires:

(1)

Airport: Means the Lafayette Regional Airport.

(2)

Airport elevation: Means the established elevation of the highest point on the usable landing area.

(3)

Airport hazard: Means any structure, tree or use of land which obstructs the airspace required for, or is otherwise hazardous to, the flight of aircraft in landing or taking off at the airport.

(4)

Airport reference point: Means the point established as the approximate geographic center of the airport landing area and so designated.

(5)

Board of appeal: Means a board consisting of five (5) members appointed by the Lafayette Parish Police Jury as provided in Section 9.

(6)

Height: For the purpose of determining the height limits in all zones set forth in this ordinance and shown on the zoning map, the datum shall be mean sea level elevation unless otherwise specified.

(7)

Heliport: Means that paved surface used primarily for the takeoff and landing of helicopters.

(8)

Precision instrument runway: "Precision instrument runway" means a runway having an existing instrument approach procedure utilizing an Instrument Landing System (ILS), or a Precision Approach Radar (PAR). It also means a runway for which a precision approach system is planned and is so indicated by an FAA approved airport layout plan; or any other FAA planning document.

Landing area: Means the area of the Airport used for the landing, taking off or taxiing of aircraft.

(10)

Map: Means the Airport Zoning Map which is designated Exhibit "A", dated December 14, 1971, which is attached hereto and is on file in the office of the Clerk of Court of the Parish of Lafayette and Parish of St. Martin.

Nonconforming use: Means any structure, tree, natural growth or use of land which is inconsistent with the provisions of this ordinance or an amendment thereto, and which pre-existed this ordinance or any prior ordinance or amendments thereof, and which was nonconforming prior to the adoption of said ordinance or amendment thereto.

(12)

Nonprecision instrument runway: "Nonprecision instrument runway" means a runway having an existing instrument approach procedure utilizing air navigation facilities with only horizontal guidance, or area type navigation equipment, for which a straight-in nonprecision instrument approach procedure has been approved, or planned, and for which no precision approach facilities are planned, or indicated on an FAA planning document.

(13)

Owner: Means the Parish of Lafayette or its legally constituted successor.

(14)

Person: Means an individual, firm, partnership, corporation, company, association, joint stock association, or body politic, and includes a trustee, receiver, assignee, administrator, executor, guardian or other representative.

(15)

Runway: Means the paved or water surface of an airport landing strip or proposed airport landing strip or extension used primarily for landing and takeoff of fixed-wing aircraft.

(16)

Structure: Means an object constructed or installed by man, including, but without limitation, buildings, towers, smokestacks and overhead transmission lines.

(17)

Tree: Means any object of natural growth.
