§ 23. Same—Perpetual.
(a)
Be it enacted and ordained by the Police Jury of the Parish of St. Martin, State of Louisiana, that there is hereby granted to the Texas-Louisiana Pipe Line Corporation doing business in Louisiana, its successors or assigns, a franchise and right over the public roads, streets and alleys of the Parish of St. Martin, Louisiana, not within the limits of any incorporated city, town or village, for the construction, maintenance and operation of lines of pipe or mains for supplying gas, including telephone lines and other appurtenances in connection therewith, in, over, under or along the public roads, streets and alleys of said parish not within the limits of any incorporated city, town or village.
(b)
Be it further ordained, etc., that in the exercise of the franchise over any state highways in the limits of said parish, the grantee shall first secure the written consent of the state highway engineer, and any work done on said highway shall be done in accordance with the laws relating thereto, and the regulations of the state highway engineer and state highway department.
(c)
Be it further ordained, etc., that all lines of pipe or appurtenances laid thereunder, over, in, under or along roads, streets and alleys, not a part of the state highway system, shall be laid in accordance with the specifications prescribed by the parish highway engineer, and in the absence of such specifications, shall be laid under the same specifications as prescribed for state highways; and such pipelines and appurtenances shall be so laid and constructed as not to obstruct any highway after completion, and during construction the grantee shall conduct its operations so as to interfere as little as reasonably possible with the normal use of said highway during construction.
(d)
Be it further ordained, etc., that the grantee hereunder, Texas-Louisiana Pipe Line Corporation, its successors or assigns, shall promptly repair all damage caused to the public roads, streets or alleys of the Parish of St. Martin by its operations hereunder and in case of the failure of the grantee to promptly make such repairs, the parish highway department shall be and is hereby authorized to make such repairs at the expense of the grantee and to bill the grantee thereof.
(e)
Be it further ordained, etc., that the grantee shall have the right to assign its rights under this franchise, but any assignee shall be subject to the obligations herein imposed on the grantee.
(f)
Be it further ordained, etc., that all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed.
(g)
Be it further ordained, etc., that the franchise herein granted shall not be exclusive.
