§ 35. Sorrento Pipeline Company, LLC; K/D/S Promix, LLC; Enterprise Products Operating, LLC

BE IT ORDAINED by the St. Martin Parish Council that by virtue of this ordinance, and in accordance with Section 2-11 of the Home Rule Charter for St. Martin Parish, Louisiana, and pursuant to Articles 639, et seq of the Louisiana Civil Code, that it does hereby grant unto:

Sorrento Pipeline Company, LLC;

K/D/S Promix, LLC; and

Enterprise Products Operating, LLC

a renewal of the non-exclusive franchise, right, and privilege for the construction, operation, and maintenance of the following pipelines constructed, maintained, and operated by virtue of a certain ordinance adopted by the St. Martin Parish Government (then St. Martin Parish Police Jury) on March 1, 1966:

Pipeline number 40672-Breaux Bridge A 6" owned by Sorrento Pipeline Company, LLC

B.

Pipeline number 40701-Breaux Bridge B 5" owned by Sorrento Pipeline Company, LLC

C.

Pipeline number 40732-Breaux Bridge C 6" owned by Sorrento Pipeline Company, LLC

D.

Pipeline number 40742-Breaux Bridge D 6" owned by Sorrento Pipeline Company, LLC

E.

Pipeline number 33002-DMI 8" owned by K/D/S Promix, LLC

F.

Pipeline number 34706-Promix Main Line 8" owned by K/D/S Promix, LLC

The renewal of the aforesaid non-exclusive franchise shall be and is in favor of the successor of the original franchisee, to wit: Enterprise Products Operating, LLC.

BE IT FURTHER ORDAINED that the St. Martin Parish Government hereby agrees that all of the terms, conditions, and provisions of the ordinance adopted on March 1, 1966, shall be applicable to this edict renewing the said franchise except that the bond requirements set forth in Section 7 of the said ordinance shall be and is hereby waived and abandoned.

BE IT FURTHER ORDAINED that the term of the renewal of the said ordinance of March 1, 1966, shall be for the length of time and under the conditions set forth in Section 8 thereof.

BE IT FURTHER ORDAINED that the Parish President be and is hereby authorized to execute any and all documents necessary to effect the terms and provisions of this edict including the incorporation thereof of any and all additional terms which he may deem necessary and proper in the exercise of his uncontrolled discretion set forth herein.

BE IT FURTHER ORDAINED that the provisions of this ordinance are hereby declared to be severable, and if any provision, word, phrase, or clause of this ordinance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect the validity of the remaining portions thereof.

This Ordinance shall become effective as provided by Section 2-12 of the Home Rule Charter of St. Martin Parish, Louisiana.
