  § 48. Allen's TV Cable Service, Inc.

    An ordinance to renew a franchise in favor of Allen's TV Cable Service, Inc., its successors, lessees, and assigns, to use the public places and public servitudes to build, construct, operate, and maintain a cable telecommunications system and associated appurtenances in, over, under, along, and across the streets, alleys, servitudes, utility easements, parkways, and public places within St. Martin Parish, Louisiana, either on poles owned or poles leased from existing public utilities, with their consent, or on poles to be erected or through cables to be laid underground for the purpose of distributing and transmitting telecommunications signals, impulses, and other electronic data and services to the inhabitants, residences, and commercial establishments thereof, and setting forth conditions accompanying the granting of this Franchise; the original franchise having become effective on August 21, 1983.

    Whereas, the St. Martin Parish Government has previously granted a franchise to Allen's TV Cable Service, Inc. for the purposes set forth in the heading of this ordinance to serve the "upper" portion of St. Martin Parish, Louisiana, the said franchise having become effective for twenty (20) years commencing on August 21, 1983; and

    Whereas, Section 10 of the subject franchise accord permits a renewal of the franchise for a fifteen (15) year period at the option of franchisee; and

    Whereas, Allen's TV CAble Service, Inc. has advised St. Martin Parish Government of its intent and desire to exercise its renewal rights under the original agreement; and

    Whereas, the St. Martin Parish Government has concluded that it is in the best interests of the citizens of St. Martin Parish to renew the original franchise contract.

    Be it, therefore, ordained by the St. Martin Parish Council that Parish President Scott A. Angelle be authorized to sign and execute the necessary documents to effect the renewal of the original franchise accord in favor of Allen's TV Cable Service, Inc. relative to "upper" St. Martin Parish, the original instrument having taken effect on August 21, 1983.

    Be it further ordained that the term of the renewed franchise shall be fifteen (15) years from the expiration date of the original contract, October 21, 2003.

    And the ordinance was declared adopted this 4th day of November, 2003.
