§ 62. Prairie Des Femmes Water Corporation.

An ordinance granting a franchise to Prairie Des Femmes Water Corporation, defining its boundaries within St. Martin Parish, authorizing joinder with St. Landry Parish, and permitting intergovernmental agreements:
BE IT RESOLVED that the St. Martin Parish Police Jury does hereby:
I.(a)
Grant a franchise, pursuant [to] LSA-R.S. 33:4361, to Prairie Des Femmes Water Corporation to construct and operate a water distribution system within and for that part of the area within the confines of St. Martin Parish lying within the following area:
Beginning at a point which is the confluence of Bayou Carencro, Bayou Fuselier and the Vermilion River; said point also being the common boundary of St. Landry Parish, St. Martin Parish and Lafayette Parish; thence following the meanderings of Bayou Fuselier in a northerly direction to its intersection with Bayou Bourbeaux; thence following the meanderings of Bayou Bourbeaux in a northwesterly direction to its intersection with the centerline of Louisiana Highway 93; thence in a westerly direction along the centerline of Louisiana Highway 93, a distance of 5,400 feet; thence in a due north direction for a distance of 7,000 feet to Bayou Bourbeaux; thence following the meanderings of Bayou Bourbeaux in a northwesterly direction to its intersection with Coulee de Marks; thence following the meanderings of Coulee de Marks in an easterly than a south-easterly direction to its intersection with Bayou Fuselier; thence following the meanderings of Bayou Fuselier in a south-easterly direction to its intersection with the western corporate limits of the Town of Arnaudville; thence southerly along the western corporate limits line and a projection thereof to the intersection with the centerline of Bayou Pont Brule; thence following the meanderings of Bayou Pont Brule in a southwestern then southerly direction to its intersection with the Lafayette Parish-St. Martin Parish Line; thence westerly along said parish boundary line to its intersection with the centerline of the Vermilion River; thence following the meanderings of the Vermilion River in a north-westerly direction to its intersection with Bayou Carencro and Bayou Fuselier which is the point of beginning.
(b)
This franchise shall be a nonexclusive franchise.
(c)
The term of this franchise shall be ninety-nine (99) years from date hereof, with the first right of renewal in favor of said corporation.
(d)
The grant of this franchise includes the right, power and privilege to use all rights-of-way belonging to the St. Martin Parish Police Jury for the laying of pipes for this water distribution system, without cost to the grantee. Any damage to the public right-of-ways of this parish by reason of the exercise of the franchise herein granted shall be repaired at the expense of grantee.
(e)
Grantee agrees to proceed with all due diligence and the taking of all actions necessary and incidental to the obtainment of federal (and state) grants and loans for the financing of the complete waterworks system within the aforesaid area, including the issuance of bonds, the advertising and award of construction contracts, and taking all other action necessary and incidental to the creation by the corporation of a water system.
(f)
This franchise is a property right and may be assigned by the grantee to any other person, firm or corporation only with the consent of the granting body.
II.
The said corporation is authorized to enter into a co-operative effort with St. Landry Parish to accomplish its purpose of creating a water system in the area described above.
III.
The said Water Corporation is further granted the authority to enter intergovernmental agreements with St. Landry Parish, appropriate municipalities, or other political subdivisions all as may be necessary and proper to accomplish its purposes.
And the ordinance was declared adopted on this 3 rd day of February, 1998.
