Article IV. FIRING RANGE PERMIT |
§ 20-89. Location restrictions.
(a)
No permit shall be granted for any premises situated so that any public playground or any building used as a church, synagogue, public library, or school lies within an area defined as one that is 1½ miles in length and the lateral measurement of the firing line in width, downrange of the firing line, that is, in the direction of the line of fire.
(b)
No permit shall be granted, pursuant to this article, for any premises situated so that any residence, dwelling house, or other buildings used principally as a place of habitation, lies within an area defined as one that is 1½ miles in length and the lateral measurement of the firing line in width, downrange of the firing line, that is, in the direction of the line of fire. Exceptions to this subsection may be granted by the written consent of a majority of the property owners owning such residences, dwellings, houses, or other buildings used principally as a place of habitation. Once the consent required by this subsection has been obtained, it will not again be required unless the premises has been without a permit for a period in excess of six months. For purposes of this article, the firing line is defined to be the customary point where firearms are discharged at the facility.
(c)
The measurement of the distance required in subsections (a) and (b) of this section shall be made from the nearest point of the property line of the church, synagogue, library, playground, school, residence, dwelling house, or other building used principally as a place of habitation, to the boundary of the area as defined in subsections (a) and (b) of this section, to wit, an area 1½ miles downrange in length, and the lateral measurement of the firing line in width.
(d)
The permit envisioned under the article shall not permit the sale of alcoholic beverages.
