§ 24-152. Applicability.

The provisions of this article shall apply to all borrow pits located in the unincorporated areas of St. Martin Parish, except such borrow pits in existence and operation prior to the effective date of this article. However, any change in the ownership of any such borrow pit shall result in the application of all aspects of this article, including the requirements of obtaining a permit and maintaining all bonds required to secure the implementation of restoration plans where mandated.

All borrow pits, including those in existence at the time of the effective date of this article, shall be operated in accordance with all applicable federal, state, and local laws, rules and regulations and all permits granted by the state and/or the United States of America or any regulatory agencies thereof.
