§ 26-9. Unlawful wearing of clothing.
(a)
It shall be unlawful for any person to wear pants, trousers, shorts, skirts, dresses, or skorts in any public place or place open to the public which either intentionally exposes underwear or which intentionally exposes any portion of the pubic hair, cleft of the buttocks, or genitals.
(b)
The provisions of subsection (a) of this section shall not apply to any of the following:
(1)
Clothing worn in a private residence.
(2)
Swimming attire worn at a swimming pool.
(3)
Clothing worn by participants in conjunction with an organized fashion show.
(c)
If a person who has not attained the age of 17 years is determined to be in violation of subsection (a) of this section, a citation shall be issued to the custodial parent or parents, or the person legally responsible for the acts of the said person; and the said custodial parent or parents, or the person legally responsible for the acts of the juvenile, shall be subject to a fine of not less than $25.00 and not more than $300.00. In addition, both the juvenile and his custodial parent or parents or other person legally responsible for the said juvenile shall be ordered to perform 40 hours of court-approved community service.
(d)
If a person who is 17 years of age or older is determined to be in violation of subsection (a) of this section, a citation shall be issued to him or her and he or she shall be fined not less than $25.00 and not more than $300.00. In addition, the said offender shall be ordered to perform 40 hours of court-approved community service.
(e)
The violation of subsection (a) of this section shall not, in and of itself, be grounds for an arrest or for a full search of the person cited.
