§ 36-78. Bond.

  • (a)

    No landfill license shall be issued or effective unless there is on file with the parish a performance bond in the amount of one year's net revenues to assure that:

    (1)

    The licensee, his agents and servants, will comply with all the terms, conditions, provision requirements and specifications contained in this article.

    (2)

    The licensee, his agents and servants, will faithfully operate the sanitary landfill for which the permit is issued in accordance with the provisions of this article.

    (3)

    The licensee, his agents and servants, will hold harmless the parish from any expense incurred through the failure of the permittee, his agents, and servants, to operate and maintain the sanitary landfill as required by this article, including any expense the parish may be put to for correcting any condition or violation of this article by the parish's own labor and equipment, whenever the parish president or his designee determines it is necessary for the parish to correct any condition in violation of this article, or from any damages growing out of the negligence of the permittee or his agents or servants.

    (4)

    The proposed site will include recycling to remove glass, aluminum, ferrous metals, compostable materials, plastics, household hazardous waste out of the waste stream by 1990, with a schedule for that removal to be approved by the parish.

    (5)

    The proposed site application contains provisions whereby the parish may enter into an agreement to ensure a partnership arrangement between the sanitary landfill owner and the parish for the landfill.

    (b)

    Before acceptance, all bonds shall be approved by the parish council and deposited with the parish treasurer, who shall give official receipt therefor, reciting that said cash has been deposited in compliance with and subject to the provisions of this article.
