§ 22. Southern National Gas Company—Perpetual.

  • (a)

    Be it ordained by the Police Jury of the Parish of St. Martin, State of Louisiana, in regular session legally convened, that there is hereby granted to Southern Natural Gas Company, its successors and assigns, a nonexclusive franchise, right and permit to construct, maintain, operate, renew, repair, change the size of, relocate, remove and/or replace a pipeline or pipelines for the transportation of oil, gas, petroleum products or any other material or substance which can be transported through a pipeline, or any one or more of said substances, under and across the public roads and highways of the Parish of St. Martin, State of Louisiana, not within the limits of any incorporated city, town or village, in accordance with the requirements, rules and regulations of the Director of Department of State Highways of the State of Louisiana, in such cases made and provided.

    There is attached to this ordinance as part thereof a map or plat, marked Exhibit A, on which is shown shaded in red the general direction and route of the presently proposed initial or first pipeline of the Southern Natural Gas Company as it is projected to run through the Parish of St. Martin.

    (b)

    Be it further ordained, that Southern Natural Gas Company, and its successors and assigns, in accepting the franchise, permit, privilege and right by this ordinance granted, agrees to save and hold harmless the Police Jury of the Parish of St. Martin, State of Louisiana, from any loss, damage or expense which it may suffer as a result of the construction, maintenance and operation of said pipeline or pipelines, and agrees to restore said public roads and highways to the same condition in which they were at date of installation of any crossing or crossings under the franchise and rights herein granted.

    (c)

    Be it further ordained, that none of the structures or installations listed in Section 1 of this ordinance shall, at any time, interfere with the use, repair, maintenance, improvement or drainage of public roads, streets, levees and drainage channels of the Parish of St. Martin. Grantee binds and obligates itself to raise or lower such installations and structures at its expense in the event same should unduly interfere with the use, repair, maintenance, drainage or improvement of public roads, streets, levees and drainage channels of St. Martin Parish; but in the event such interference cannot be overcome or removed by the raising or lowering of said installations and structures, then Southern Natural Gas Company, at its expense, agrees to relocate such installations and structures nearest to the original location where such installations and structures will not unduly interfere with the use, repair, maintenance, drainage or improvement of public roads, streets, levees and drainage channels of St. Martin Parish.
