Article VI. VIDEO DRAW POKER DEVICES |
§ 20-172. Definitions.
For the purposes of this article the following definitions apply:
Division means the division in the office of state police, department of public safety and corrections, that provides investigatory, regulatory, and enforcement services to the Louisiana Gaming Control Board in the implementation, administration, and enforcement of the Louisiana Gaming Control Law, including La.R.S. 27:1, et seq.
Major state or interstate highway means that highway as defined by the division as set forth in state law that has at least an 80,000 pound load limit.
Operate , operation , and/or operating mean the privilege of operating a video draw poker device in accordance with this chapter and the provisions of the Louisiana Video Draw Poker Devices Control Law, La.R.S. 27:401, et seq.
Prohibited property means any property on the National Register of Historic Places, any public playground, any residential property, or any building used primarily as a church, synagogue, public library, or school.
Qualified establishment means the types of establishments that may operate video draw poker devices at their licensed establishments provided in La.R.S. 27:412.
Qualified establishment location means the physical location described in the video draw poker devices license of a qualified establishment where video draw poker devices may be operated.
Residential property means any property which is wholly or partly used for or intended to be used for living or sleeping by human occupants and which includes one or more rooms, including a bathroom and complete kitchen facilities. Residential property shall include a mobile home or manufactured housing, provided that it shall have been in its present location for at least 60 days. Residential property shall not include any hotel, motel, or bed and breakfast establishment.
Truck stop facility includes all of the buildings, appurtenances, out buildings, parking lots (whether paved or not), and all other land that comprises the part of the facility as set forth in the application to the division. It is the intent of this definition to include all of the five developed contiguous acres as set forth in La.R.S. 33:4862.6(A)(4)(c).
Video draw poker device means any unit, mechanism, or device authorized pursuant to the provisions of the Louisiana Video Draw Poker Devices Control Law, La.R.S. 27:401, et seq, that, upon insertion of cash, is available to play or simulate the play of the game of draw poker or other card games approved by the division utilizing a video display and microprocessors in which the player may win games or credits that can be redeemed for cash only. The term does not include a device that directly dispenses coins, cash, tokens, or anything else of value, except the ticket voucher required in accordance with the provisions of the Louisiana Video Draw Poker Devices Control Law. The term does not include any device authorized to be used in the conducting of charitable gaming. Furthermore, the term does not include video lineup games, mechanical reel games, or any combination thereof, or any slot machine as defined by La.R.S. 27:53(14).
Video draw poker means any card game approved by the division that utilizes one deck of cards per hand with multiple hands permitted per game.
