§ 20-173. Regulations and restrictions.

  • In accordance and consistent with R.S. 27:413, a video draw poker device may be placed and used only in a qualifying establishment which has been issued a special state license for the placement of such devices. The term "qualifying establishment" means an establishment that has a state Class "A" general retail or a Class "A" restaurant permit, and an equivalent local permit, for the sale of alcoholic beverages for on-premises consumption, or a state racing commission licensed race track, pari-mutuel wagering facility or offtrack wagering facility, or a qualified truck stop facility as defined in R.S. 27:416. All businesses and all buildings and structures used to house qualifying establishments shall conform to all state and local regulations pertaining to such businesses, buildings and structures including but not limited to zoning regulations, building codes, health and sanitary codes, the Louisiana Video Draw Poker Devices Control Law, R.S. 27:401 et seq.
