§ 22-5. Load limits.

  • (a)

    Except as otherwise provided herein, it shall be unlawful for any person to operate any vehicle which has a total weight in excess of ten tons upon any parish bridge located on a parish road.

    (b)

    Except as otherwise provided herein, it shall be unlawful for any person to operate any vehicle which has a total weight in excess of eight tons on any levee road under the jurisdiction of the parish council.

    (c)

    It shall be unlawful for any person to drive or operate any motor vehicle, tractor, cart, truck and trailer, or any combination thereof used together, having a weight of five tons or more when wet, in all such road sections being within the right-of-way of the West Atchafalaya Basin Protection Levee; however, such defined vehicles may have and enjoy unrestricted use of such roads upon the owner thereof posting with and in favor of the parish council a cash bond in the principal sum of $14,500.00 thereon approved by the parish council thereby securing unto it all cost of extraordinary repairs to and maintenance expenditures for such road sections resulting from the use by such defined vehicles of such section as certified by the parish engineer. Whoever violates the provisions of this subsection shall be guilty of a misdemeanor and punished by a fine not in excess of $500.00 or imprisonment in the parish jail for a term in excess of 30 days, or both. Such provision shall be enforced by attaching said requirement to request for letters of no objections and/or other permits and privileges as might be granted under the discretionary powers of the parish council.

    (d)

    No person shall drive a vehicle carrying a load in excess of that permitted, as established by ordinance for that bridge, road or street.

    (e)

    Any person in violation of this subsection shall be deemed guilty of a misdemeanor and upon conviction shall be fined not more than $500.00 or serve 30 days in the parish jail, or both.
