Article IV. SITING REQUIREMENTS FOR WASTE DISPOSAL FACILITY |
§ 36-109. Permits required.
All new waste disposal facilities located in the parish will be required to apply for and purchase an initial permit and an annual renewal permit. Waste disposal facilities existing and operating as of the effective date of the ordinance from which this article is derived will be granted a permit automatically provided they are meeting all legal requirements and hold all permits necessary to their operation at the time of adoption of the ordinance from which this article is derived, (February 4, 1992). Facilities in operation on the effective date of the ordinance from which this article is derived shall provide the parish council with copies of all permits required for operation within 30 days of such items being requested by the parish council. The operator shall furnish to the parish council any new or modified permits to operate received by the waste disposal facility operator within 30 days of their receipt by the operator. Each waste disposal facility operator who seeks to be considered for the purposes of this section as having been in operation on the effective date of the ordinance from which this article is derived shall, on or before May l, 1992, file with the secretary of the parish council any documents and/or other evidence which they assert reflects the facility's active and actual operations on effective date of the ordinance from which this article is derived. Facilities existing and operating at the time of adoption of the ordinance from which this article is derived will only be subject to the annual permit renewal process and fee if any of the following events occur:
(1)
The facility seeks to substantially enlarge its scope of operations or physical size.
(2)
The facility is cited for an environmental violation or is issued an environmental compliance order by the Louisiana Department of Environmental Quality or United States Environmental Protection Agency.
(3)
The facility is required to obtain a permit to operate by the Louisiana Department of Environmental Quality or the United States Environmental Protection Agency at any time after the effective date of the ordinance from which this article is derived.
