§ 38-128. Waterworks District No. 4.
(a)
There is hereby created a waterworks district which shall comprise and embrace all that territory within the following described boundaries:
Commence at the point of beginning which point is the intersection of the north line of Section 23, Township 9 South - Range 7 East and the centerline of the West Atchafalaya Basin Protection Levee;
Thence in a southeasterly and southerly direction along the centerline of the West Atchafalaya Basin Protection Levee to the point of intersection with the south line of Section 20, Township 10 South—Range 8 East;
Thence in a westerly direction along the south line of Sections 20 and 19, Township 10 South—Range 8 East and the south line of Sections 24 and 23, Township 10 South—Range 7 East to the southwest corner of Section 23, Township 10 South—Range 7 East;
Thence in a southerly direction along the east line of Sections 27 and 34, Township 10 South—Range 7 East and the east line of Section 3, Township 11 South—Range 7 East to the point of intersection with the St. Martin - Iberia Parish boundary line which parish line is the centerline of Coulee du Portage;
Thence in a generally southwesterly direction along the St. Martin - Iberia Parish line to the westerly most point of intersection of Louisiana Highway 345 and the southerly line of Section 51, Township 11 South—Range 7 East;
Thence in a west southwesterly direction along the southerly line of Section 51, Township 11 South—Range 7 East to the southwest corner of Section 51, Township 11 South—Range 7 East and the range line between Range 6 East and Range 7 East;
Thence in a northerly direction along the range line between Range 6 East and Range 7 East to its point of intersection with a line 200 feet southerly of and distant from the centerline of Choppy Cade Road;
Thence in a westerly direction along a line 200 feet southerly of the centerline of Choppy Cade Road to its point of intersection with the westerly line of Section 60, Township 11 South—Range 6 East;
Thence in a southwesterly direction along westerly line of Section 60, Township 11 South—Range 6 East to the northeasterly corner of Section 4, Township 11 South—Range 6 East;
Thence in a westerly direction along the northerly line of Section 4, Township 11 South—Range 6 East to the centerline of a power line;
Thence in a northerly direction along the centerline of a power line to its point of intersection with the northerly line of Section 3, Township 11 South—Range 6 East;
Thence in an easterly direction along the northerly line of Section 3, Township 11 South—Range 6 East to its point of intersection with a line 200 feet westerly and parallel to the centerline of Choppy Cade Road;
Thence in a northerly direction along a line of 200 feet westerly of the centerline of Choppy Cade Road to its point of intersection with the centerline of Louisiana Highway 96;
Thence in an easterly direction along the centerline of the Louisiana Highway 96 to its point of intersection with the range line between Range 6 East and Range 7 East;
Thence in a northerly direction along the range line between Range 6 East and Range 7 East to the southeasterly corner of Section 48, Township 10 South—Range 6 East;
Thence in a southwesterly direction along the southerly line of Section 48, Township 10 South—Range 6 East to its intersection with the easterly projection of the north line of Section 75, Township 10 South—Range 6 East;
Thence in a westerly direction along the easterly projection on the northerly line and the northerly line of Section 75, Township 10 South—Range 6 East to its intersection with the centerline of Levert Street;
Thence in a northerly direction along the centerline of the Levert Street to a point 200 feet northerly of St. John Bridge Road;
Thence in an easterly direction along a line 200 feet northerly and parallel to St. John Bridge Road to a point 200 feet easterly of Louisiana Highway 347;
Thence in a southerly direction along a line 200 feet easterly and parallel to Louisiana Highway 347 to a point 200 feet northerly of St. John Field Road;
Thence in an easterly direction along a line of 200 feet northerly and parallel to St. John Field Road to its intersection with the range line between Range 6 East and Range 7 East;
Thence in an northerly direction along the range line between Range 6 East and Range 7 East to its point of intersection with the northwesterly line of Section 68, Township 10 South—Range 7 East;
Thence in a northeasterly and easterly direction along the northwesterly line of Section 68 and Section 63, Township 10 South—Range 7 East to the northeasterly corner of Section 63, Township 10 South—Range 7 East;
Thence in a southerly direction along the easterly line of Section 63, Township 10 South—Range 7 East to its point of intersection with the northerly line of Section 8, Township 10 South—Range 7 East;
Thence in an easterly direction along the northerly line of Section 8, Township 10 South—Range 7 East to the southwest corner of Section 4, Township 10 South—Range 7 East;
Thence in a northerly direction along the westerly line of Section 4, Township 10 South—Range 7 East and the westerly line of Sections 33, 28 and 21, Township 9 South—Range 7 East to the northwest corner of Section 21, Township 9 South—Range 7 East;
Thence in an easterly direction along the northerly line of Sections 21, 22, and 23, Township 9 South—Range 7 East to the point of beginning.
(b)
The waterworks district shall be known and is hereby designated as "Waterworks District No. 4 of the Parish of St. Martin, State of Louisiana," and as thus created shall constitute a public corporation and political subdivision of the state, and shall have all the powers and privileges granted by the Constitution and statutes of the state to such subdivisions, including the authority to incur debt, to issue bonds and to levy taxes and assessments.
(c)
That in accordance with the provisions of Sections 3812 and 3813 of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3812 and 33:3813), a five member board of waterworks commissioners, to govern the district, shall be appointed by subsequent resolution of this council, it being provided that, each of the said commissioners appointed shall be a resident of said waterworks district and own lands assessed at not less than $500.00 in the said district, as shown by the assessment roll of the parish, for the year 1993, the same being the last assessment roll completed, filed and of record at this time.
(d)
The domicile of the waterworks district shall be within the corporate limits of the waterworks district.
